By participating in the City Stop “No Brainer” Video Poker Promotion (“Promotion”), the participant agrees to be bound by all of the following rules, regulations, and provisions, and any applicable federal, state, or local laws or regulations.
The Promotion will begin at 12:00 a.m. on August 1, 2008, and will end at 12:00 AM on January 31, 2009 (“Promotion Period”).
To be eligible for the Promotion, a participant must be at least twenty-one (21) years of age in order to participate in the Promotion. Participant must enroll as a “City Stop Rewards” member in order to be eligible.
To be eligible for the Promotion, a participant must win a One Thousand Dollar ($1,000) or greater jackpot during the Promotional Period with a minimum wager of at least One Dollar and Twenty-Five Cents ($1.25) (“Qualifying Jackpot”) on a gaming device located in a participating City Stop convenience store (“Eligible Machine”).
Employees (leased or otherwise) of City Stop and/or affiliated companies, Nevada Gaming Partners, LLC (“NGP”), and/or of City Stop’s advertising agency, law firm, and/or their immediate spouses, children, or other relatives, are not eligible to participate in this Promotion.
Eligible participants must immediately notify a City Stop store clerk upon winning a Qualifying Jackpot on an Eligible Machine. Upon verification of an eligible player with a Qualifying Jackpot, the City Stop store clerk will present the participant with an entry form. That form must be filled out completely and accurately signed where indicated and returned within fifteen (15) minutes of the eligible participant being presented with the form to the same store clerk who verified the player’s eligibility.
By completing and returning the form, participants grant an irrevocable license to NGP, City Stop, Inc., and/or any of their affiliated companies, to use any information contained in the form, likenesses, and other information about the participant for marketing and promotional purposes of any kind, at any time, in any media, without compensation to the participant.
The entry form is not properly submitted unless it is completed accurately and completely by the participant and signed. Acceptance of an entry form by a City Stop store clerk does not waive the responsibility of the participant to present a form that is accurate and complete in order to remain eligible for the promotion. Failure to comply with these requirements will disqualify an otherwise eligible participant.
Any federal, state, or local taxes related to participation in this Promotion and/or the awarding of prizes in this Promotion are the sole responsibility of the participant.
This Promotion is being conducted by NGP in cooperation with City Stop, Inc., and its or their affiliated companies (“Promotion Owners”).
By participating in this Promotion, a participant agrees to defend, remise, forever release, and discharge Promotion Owners from any and all claims, demands, damages, liabilities, actions, causes of action or contingent,
asserted or unasserted, foreseeable or unforeseeable, unanticipated or unsuspected, which ever of them has or may have now or in the future, arising directly or indirectly out of or involving claims arising out of participation in
the Tournament or Cash Drawing.
Promotion Owners are and shall be the sole owners of all materials and information submitted to them and all likenesses collected in connection with the administration of this Promotion.
The participant with the highest number of Qualifying Jackpots on any Eligible Machine and who has accurately completed an entry form for each Qualifying Jackpot will be awarded a prize of Twenty Thousand Dollars ($20,000).
In the event that more than one eligible participant has the same number of Qualifying Jackpots to be eligible for the award of the $20,000 prize (“Grand Prize”), the Grand Prize will be split and shared equally among all such
eligible participants qualified for the Grand Prize.
By accepting any prize, including the Grand Prize, the winning participant agrees to defend, indemnify, hold harmless, and release Promotion Owners and it and their respective affiliates, members, directors, employees,
officers, and agents, including without limitation, their advertising and promotion agencies, from any and all liabilities, losses, or damages arising from or in connection with the awarding, receipt and/or use or misuse of prize
or participation in the Promotion.
Promotion Owners have sole and final authority to implement any changes necessary to the rules, procedures, timing, dates and/or prizes, of this Promotion at any time and for any reason.
Promotion Owners reserve the right to disqualify any person tampering with any entry or any person who is otherwise in violation of these rules.
The Promotion and these rules and regulations shall be governed by the law of the state of Nevada. Any participant agrees that any action, claim, or other dispute related to the Promotion shall be brought or raised only in Clark County, Nevada, and all such actions or claims shall be subject to binding arbitration pursuant to and in accordance with the American Arbitration Association rules and practice.
This promotion is void where prohibited or restricted by law and subject to applicable federal, state, and local laws and regulations.
